By law, the Victim Compensation Fund can only compensate for losses caused by eligible conditions caused by the events of the 9/11 terrorist attacks. Furthermore, the law requires the Special Master to take into account the facts of the claim, the harm to the claimant, and the individual circumstances of the claimant. Each award is calculated individually. Your final award is calculated using this basic formula "non-economic loss + economic loss - collateral offsets." Collateral offsets refer to compensation from other sources that you received as a result of your injury and must be subtracted from the award.
To calculate economic loss, the Victim Compensation Fund must first determine whether there is a compensable loss. There are three types of economic loss – loss of earnings or benefits, out-of-pocket medical expenses, and replacement services loss. The VCF Act defines non-economic loss as losses related to physical and emotional pain, suffering, physical impairment, loss of society and companionship, mental anguish, inconvenience, disfigurement, loss of enjoyment of life, loss of consortium, injury to reputation, and other non-pecuniary losses of any nature.
