The latest updates about hair relaxer lawsuits
So far 9,151 cases have been filed, and 7,946 of the 9,151 cases (86.83%) are still pending in MDL 3060. In October 2023, the U.S. Food and Drug Administration (FDA) proposed banning formaldehyde use in hair relaxing products due to the health effects involved. Because of this notice, hair relaxer cases are expected to increase over time, but the supposed ban was delayed to September 2024. Hair relaxing products containing formaldehyde are still available in the market.
On June 25, 2024, the Hon. Mary Rowland dismissed hundreds of cases with different schedules without prejudice: 144 cases for Schedule 1, 190 cases for Schedule 2, and 1 case for Schedule 3 due to the plaintiffs not submitting a fact sheet or not submitting a complete fact sheet. The plaintiffs need to refile their claims by June 25, 2025. If not, their cases will be converted to dismissed with prejudice, which means they will be barred from filing in the future.
