A short history of National Foam, AFFF manufacturing, and lawsuits
In January 2024, multiple companies making or selling materials containing PFAS, including National Foam, were listed as defendants in a lawsuit filed by New Hanover County. A lot of the contamination with these dangerous chemicals originates from factories, but a considerable amount comes from the use of AFFF, which was "common practice" among local fire departments, according to the lawsuit. The toxic chemicals in AFFF caused "widespread PFAS contamination," according to the legal documents.

On April 10, 2024, the office of Attorney General Todd Rokita filed a lawsuit on behalf of the state of Indiana against National Foam, as well as 21 other manufacturers, claiming they knew the health dangers of PFAS exposure. "The injury caused by PFAS contamination to the state of Indiana, the wellbeing of its residents, and its natural resources, is indivisible and attributable to all Defendants," states the lawsuit. Furthermore, the office claims that the AFFF manufacturers violated state and federal environmental regulations, as well as the Indiana Deceptive Consumer Sales Act and the Indiana Product Liability Act.
