In April 2024, the office of Attorney General Todd Rokita filed a lawsuit on behalf of the state of Indiana against 22 manufacturers of AFFF, including Dynax Corporation, claiming that they had previous knowledge about the health risks of PFAS exposure. According to the complaint, the office alleges that the companies knew of the toxic effect PFAS were having on the state's drinking water and natural resources, implying serious health risks to people across Indiana. Several days after the Indiana lawsuit, another one was filed by multiple public drinking water systems in California against 7 manufacturers of AFFF, including Dynax Corporation. While it is a major step in holding corporations responsible for contaminating water sources with PFAS, it is also one of the first to refer to the new federal drinking water standards for these hazardous chemicals, which was issued a week earlier.
The significance of this lawsuit extends beyond California, as it is expected to be consolidated with similar ones in multidistrict litigation in federal court in South Carolina. It is worth noting that the lawsuit follows several high-profile settlements between water systems and major AFFF manufacturers, including 3M Company, Du Pont de Nemours, and Tyco Fire Products, totaling over $14 billion. These funds will help public water systems to deal with PFAS detection.
