In October 2023, South Carolina Attorney General Alan Wilson filed a lawsuit against multiple companies, including Buckeye Fire Equipment, for polluting the state's resources by manufacturing AFFF. The companies "knew with substantial certainty that PFAS contained in AFFF would reach onto and contaminate State natural resources and property, including water systems, surface water, groundwater systems, and zones of influence of the areas that supply production wells within the State, [but still] manufactured, marketed, distributed, promoted, and/or sold AFFF products containing PFAS with a profit motive," according to the complaint.
Finally, in April 2024, the office of Attorney General Todd Rokita filed a lawsuit on behalf of the state of Indiana against over 20 companies, including Buckeye Fire Equipment, claiming that they were aware of the health risks and the dangers of the PFAS in their AFFF. According to the complaint, the office is alleging that the manufacturers knew of the impact the chemicals were having on Indiana's drinking water and natural resources, entailing serious health risks to residents.
